Music Will, Inc. (“Music Will,” “Our”, “us”, or “we”) is a US-based charitable nonprofit organization with the mission of transforming lives by transforming music education. We are committed to protecting the privacy of visitors who access our sites, including musicwill.org, and the subdomains shop.musicwill.org, jamzone.musicwill.org and academy.musicwill.org (collectively, the “Sites”), and any services provided through such sites and applications (collectively, “Services”).

By accessing any of Music Will’s Sites or Services, you are consenting to this Online Privacy Policy (the “Policy”). This Policy describes what information we collect from users when they visit our Sites; how such information is used; when such information may be disclosed to third parties; and how information is protected.

Our Sites are intended for use by individuals located in the United States. If you choose to access any of our Sites from outside the United States, you acknowledge that you will be transferring your information, including personal information, to the United States for storage and processing as necessary to provide you with our websites and related services.

This Policy also outlines our practices regarding the online collection of children’s personal information. While our Sites and related Services may be used and accessed by children under 13, we do not solicit or collect personal information from children under 13. In the event we discover we have collected information from a child under 13, we will take reasonable measures to promptly delete such data from our records. Please see the "Events" section for a limited exception to this general rule.

The Information We Collect and How We Use It

We offer a range of Sites and Services that are intended for students and educators. This Policy summarizes potential instances of collection and outlines how and when we may process or share such information collected.

Personal information provided by you

We collect personal information you voluntarily provide to us when you fill out forms, sign up for programs and events, register for a teacher account, request access to curricular materials, sign up for our newsletter, or contact us. Examples of such personal information include your name, email address, username/password (when registering for an account), school or organization, city and state, and other relevant contact information. We do not process sensitive information.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Donors/Payment Data

Music Will collects and uses various personal information from donors and supporters, which may include name, address, telephone number, email address, names of beneficiaries, nature and value of estates, amounts and sources of investments, provisions or gifts and supporter comments. If you choose to donate or make purchases on or through the Sites, all payment data is securely processed by GoFundMe Inc. (Donations), Cvent Inc.(Modern Band Summit), Shopify (Music Will Shop), and Stripe (Donations). Teacher Accounts

Educators over the age of 18 may create Teacher Accounts on Music Will Academy (https://academy.musicwill.org) and Music Will JamZone (https://jamzone.musicwill.org). We may provide you with the option to register with us using your existing Google account. Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Information collected from other sources

In order to enhance our ability to provide services to you and update our records, we collect limited information from third-party sources such as payment processors, donor management platforms, public databases, social media platforms, and event management platforms.

Processing of your information

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

To provide access to curricular resources and support services;
To communicate with you about our programs, updates, events and opportunities, and to thank you for your investment, provision or gift, or to provide you with a receipt for your donation;
To respond to inquiries and provide customer service;
To execute and manage transactions submitted through the Sites;
To track engagement for internal analytics and reporting, including conducting analysis of fundraising;
To request feedback on our Services;
To evaluate and improve our website, offerings, and user experience; and
To comply with our legal obligations, including to maintain donation records in accordance with requirements of federal and state laws and report to relevant federal and state agencies.

Sharing of your information

We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. (e.g., email services, form handling platforms, customer relationship management platforms, analytics, learning platforms). We may also share anonymized and aggregated data for reporting and program improvement. If required by law, we may disclose your information in response to legal requests.

Protection of your information

We implement reasonable technical and organizational measures to protect your information from unauthorized access, loss, misuse, or disclosure. Be advised that no security measures eliminate all risks. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment. We are not responsible for third-party circumvention to any privacy settings or security systems.

We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements.

Your choices

You can view and request changes to all the information you have given us, including any mailing lists you may be on, by contacting us using the contact information at the bottom of this Policy. You may also contact us to request removal of your information from our systems.

Persistent Identifiers, Cookies, and Analytics

When users interact with us and the Sites, certain information may automatically be collected, both to make our Sites and Services more interesting and useful to users and for various purposes related to our business.

Examples include the type of computer operating system, the user’s IP address or mobile device identifier, the web browser, the frequency with which the user visits various parts of our Sites or uses our Services, and information regarding the online or mobile service provider. Additionally, if you use the search function on our Sites, we may collect and retain information about your search queries. This information is collected using technologies such as cookies, flash cookies, web beacons, and other unique identifiers. This information may be collected by Music Will or by a third party. This data is principally used for internal purposes only, in order to:

provide users with access to features and activities on our Sites and Services;
customize content and improve our Sites and Services;
conduct research and analysis to address the performance of our Sites and Services; and
generate anonymous reporting for use by Music Will.

Cookies

We may use cookies (small pieces of data that store information on your browser in your computer’s hard drive) and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Sites and Services. These help us maintain the security of our Sites and Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We use conversion tracking cookies for campaigns, which analyze trends, gather broad demographic information and monitor website traffic patterns that can help us further develop and improve the design and functionality of our Sites and Services.

Similarly, we also use cookies for “retargeting” in our Internet advertising campaigns so that third party vendors can show you advertising about Music Will as you browse the Internet. Retargeting is a marketing tool that identifies you as a previous visitor to the Music Will website and targets you for specific outreach messages, encouraging you to revisit our website or consider donating. Any personal information we gather via cookies will be kept private and not shared with other organizations. We take steps to avoid the collection of information for targeted advertising purposes on pages where educational resources may be accessed by students.

Google Analytics

We utilize Google Analytics to track and analyze the use of the Services. To opt out of Google Analytics, visit https://tools.google.com/dlpage/gaoptout. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. Meta Pixel

We utilize the Meta Pixel, a tool operated by Meta that helps us understand and analyze the use of the Services and the Sites. The Meta Pixel may collect the following categories of information and share such information with Meta: (i) device and browser information, including IP address, operating system, and web browser type; (ii) page URLs, referrer URLs, and browsing activity on the Sites; (iii) cookie and identifier data, including the Pixel ID and Facebook cookies used to associate your activity with your Meta profile; and (iv) event data, including button clicks, page views, form submission actions (excluding inputted text values), and scroll depth. This data may be stored and processed by Meta, and Meta may use it for its own purposes in accordance with Meta's Privacy Policy. You can opt out of the use of your data for targeted advertising by Meta by adjusting your settings in the Ad Preferences center.

Electronic Communications

Newsletters

You can provide your email address to receive periodic newsletters from Music Will. These newsletters inform users about Music Will’s programs, events, opportunities to donate, and services. Visitors may change their preferences regarding emails at any time through the unsubscribe link in the newsletters.

SMS Messaging

If you have previously granted your express consent to receive SMS messages from Music Will for donation opportunities, events, or program updates, you may opt out at any time. Simply text the word "Stop" to the number from which you received the message. By texting "Stop," you are providing your express consent to opt out of SMS messaging, and we will promptly remove your phone number from our SMS messaging system. Please be aware that standard message and data rates may apply.

Events

Music Will may host events, including online events, to encourage users, including children, to engage with the sites and applications’ content. For such events, we typically require and collect only the information necessary for the applicable participant to participate, such as the participant’s grade, first and last name, and parent/guardian email address. We will notify the parent/guardian of the collection of information for child participants. We will not disclose any such collected information to third parties. We not retain students' personal identifying information in our databases. Any parent/guardian may request that Music Will delete their child’s information, provided that the participant may not be able to participate in the event as a result of such deletion. In those instances, we require parental consent prior to submission and will seek parental consent consistent with the requirement of COPPA.

California Privacy Rights

California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As noted above, while our Sites and related Services may be used and accessed by children under 13, we do not solicit or collect personal information from children under 13. If you are a California resident under the age of 18, and a registered user of any Site where this Policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. Changes To This Policy and Notice

Music Will reserves the right to revise this Policy at any time for any reason in our sole discretion by posting an updated Policy without advance notice to you. Such revisions shall be effective immediately upon posting and if you use Music Will’s sites or applications after they become effective it will signify your agreement to be bound by the changes.
